Scope and Application of This Policy

This Privacy Policy applies to all individuals and organizations ('you,' 'your,' or 'User') who access, register on, or use any service, feature, or content offered by CallQuants LLP ('CallQuants LLP,' 'we,' 'us,' or 'our') through:

  • The website callquants.us, targeting US-based businesses and users;
  • The website callquants.in, targeting India-based businesses and users;
  • The CallQuants web application accessible at app.callquants.us or equivalent subdomains;
  • The CallQuants Android mobile application;
  • The CallQuants AI Voice Agent system;
  • Any APIs, integrations, or communications associated with the foregoing.

This Policy does not apply to the data practices of third-party services, platforms, or integrations that you may use in connection with the CallQuants platform. You should review the privacy policies of such third parties independently.

Data Controller / Data Fiduciary Information

CallQuants LLP is the Data Controller (as defined under applicable US and EU/international frameworks) and the Data Fiduciary (as defined under India's Digital Personal Data Protection Act, 2023) with respect to the personal data processed through the Platform.

Personal Data We Collect

3.1 Data You Provide Directly

We collect personal data that you directly provide to us, including:

  • Registration and Account Data: Name, email address, phone number, company name, job title, and password when you create an Account.
  • Business Information: Company name, size, industry, team structure, and business contact details provided during onboarding or profile setup.
  • Payment Information: Billing name, address, and payment method details. Note: Full payment card details are processed by our third-party payment processors and are not stored on CallQuants LLP systems.
  • Communications Data: Messages, inquiries, and support requests submitted through contact forms, email, or WhatsApp.
  • Configuration Data: AI Voice Agent configurations, scripts, knowledge bases, and campaign parameters you set up on the Platform.

3.2 Data Collected Automatically

We automatically collect certain technical and usage data when you access the Platform:

  • Log and Device Data: IP address, browser type and version, operating system, device type, timestamps, and referring URLs.
  • Usage Data: Pages visited, features used, session duration, clicks, and navigation patterns within the Platform.
  • Location Data: Approximate geographic location derived from IP address. We do not collect precise GPS location data unless explicitly enabled.
  • Cookie and Tracking Data: Data collected through cookies, pixels, and similar tracking technologies as described in Section 10.

3.3 Call and Communication Data

The core functionality of our Platform involves processing call and communication data. This includes:

  • Call Recordings: Audio recordings of telephone calls made or received through or via the Platform by you or your team, subject to your configuration and applicable consent obligations.
  • Transcripts: Text transcriptions of recorded calls generated by our AI systems.
  • AI Analysis Outputs: Sentiment scores, intent analyses, coaching recommendations, lead scores, and Meaningful Interaction (MI) determinations.
  • Third-Party Caller Data: Personal data relating to individuals (prospects, customers) who participate in calls handled through the Platform. You, as the data controller of such individuals' data, are responsible for obtaining all required consents from such individuals.

3.4 Data from Third-Party Integrations

If you connect third-party services (including WhatsApp Business API, Exotel, Tata Communications, CRM systems, or others) to the Platform, we may receive data from those services in accordance with their respective terms and your configuration.

Purposes of Data Processing and Legal Basis

4.1 Purposes of Processing

CallQuants LLP processes personal data for the following purposes:

  • Service Delivery: To provide, operate, maintain, and improve the Platform and all Services, including call recording, transcription, AI analysis, and coaching features.
  • Account Management: To create, manage, and authenticate user Accounts and Subscriptions.
  • Billing and Payments: To process payments, issue invoices, and manage Subscription billing.
  • AI Model Operation and Improvement: To operate AI transcription, voice agent, sentiment analysis, and scoring systems, and to improve their accuracy and performance using aggregated and anonymized data.
  • Customer Support: To respond to your inquiries, resolve disputes, and provide technical assistance.
  • Security and Fraud Prevention: To detect, investigate, and prevent unauthorized access, fraud, abuse, and security incidents.
  • Legal Compliance: To comply with our legal obligations under applicable laws and regulatory requirements.
  • Analytics and Platform Improvement: To analyze usage patterns, monitor performance, and develop new features and improvements.
  • Marketing Communications: To send service updates, feature announcements, and promotional communications to you, subject to your opt-out rights.

4.2 Legal Basis for Processing

For US Users, we process your personal data based on: (a) your consent where required; (b) performance of a contract with you; (c) our legitimate interests in operating and improving the Platform; and (d) compliance with legal obligations. For India Users, processing is based on: (a) your consent as a Data Principal under the DPDP Act, 2023; (b) legitimate uses as provided under applicable Indian law; and (c) compliance with legal obligations.

Sharing of Personal Data

5.1 General Principle

CallQuants LLP does NOT sell your personal data to third parties. We do not rent, trade, or broker your personal data. We share your data only in the limited circumstances described in this Section.

5.2 Service Providers and Sub-Processors

We share personal data with third-party vendors and service providers who process data on our behalf to help us deliver the Services. These include providers of:

  • Cloud infrastructure and hosting services;
  • AI/ML model APIs and processing infrastructure;
  • Payment processing services;
  • Communication and telephony infrastructure (e.g., VoIP providers);
  • Analytics and monitoring tools;
  • Customer support software.

All such service providers are contractually bound to process your data only on our instructions, maintain appropriate security standards, and not use your data for their own purposes.

5.3 Third-Party Caller Data — Your Responsibility as Data Controller

IMPORTANT: When you use the Platform to record or process calls involving your customers, prospects, or other individuals, you act as the Data Controller (or Data Fiduciary) with respect to those individuals' personal data. You are solely responsible for: (a) informing such individuals that their calls may be recorded; (b) obtaining all legally required consents; (c) complying with all applicable data protection laws with respect to such individuals' data; and (d) responding to any data subject rights requests from such individuals. CallQuants LLP acts as a data processor / sub-processor with respect to such data and processes it only on your instructions.

5.4 Legal Requirements and Protection of Rights

We may disclose your personal data if we believe in good faith that such disclosure is necessary to: (a) comply with applicable law, regulation, legal process, or governmental request; (b) enforce our Terms of Use or other agreements; (c) protect the rights, property, or safety of CallQuants LLP, our users, or the public; or (d) detect, prevent, or address fraud, security, or technical issues.

5.5 Business Transfers

In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy involving CallQuants LLP, your personal data may be transferred as part of such transaction. We will provide notice of any such transfer and of any material change to the applicable privacy policy.

International Data Transfers

CallQuants LLP is headquartered in Mumbai, India, and its servers and infrastructure may be located in India, the United States, or other countries. By using the Platform, you acknowledge that your personal data may be transferred to, stored in, and processed in countries other than your country of residence.

For India Users: Personal data may be transferred outside India subject to the conditions prescribed under the Digital Personal Data Protection Act, 2023, and any applicable rules or government notifications. Such transfers will occur only where adequate safeguards are in place or where expressly permitted by applicable Indian law.

For US Users: Personal data may be transferred to India or other countries. We implement appropriate contractual and technical safeguards to protect your data during such transfers.

Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements.

Upon the expiry of applicable retention periods, we will securely delete or anonymize your personal data. You may request earlier deletion subject to Section 9 of this Policy.

Data Security

CallQuants LLP implements reasonable and appropriate technical and organizational security measures designed to protect your personal data against unauthorized access, disclosure, alteration, destruction, or loss. These measures include:

  • End-to-end encryption of call recordings and sensitive data in transit and at rest;
  • Access controls and role-based permissions limiting access to personal data to authorized personnel on a need-to-know basis;
  • Audit logging of access to and operations on sensitive data;
  • Regular security assessments and vulnerability testing;
  • Incident response procedures for detecting and responding to data breaches.
IMPORTANT DISCLAIMER: No method of electronic transmission or storage is one hundred percent (100%) secure. While we take commercially reasonable steps to protect your data, CallQuants LLP cannot guarantee absolute security. You use the Platform at your own risk. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify you and applicable regulatory authorities as required by law.

Your Data Rights

9.1 Rights Applicable to All Users

Subject to applicable law and our verification of your identity, you have the following rights with respect to your personal data:

  • Right to Access: Request confirmation of whether we process your personal data and obtain a copy of such data.
  • Right to Correction/Rectification: Request correction of inaccurate or incomplete personal data.
  • Right to Deletion/Erasure: Request deletion of your personal data, subject to our legal obligations to retain certain data and the rights of third parties.
  • Right to Withdraw Consent: Where processing is based on your consent, withdraw such consent at any time without affecting the lawfulness of processing prior to withdrawal.
  • Right to Object: Object to certain processing activities, including direct marketing.

9.2 Additional Rights — US Users (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):

  • Right to Know: The right to know what personal information we collect, use, disclose, sell, or share, and for what purposes.
  • Right to Delete: The right to request deletion of your personal information, subject to certain exceptions.
  • Right to Correct: The right to correct inaccurate personal information.
  • Right to Opt-Out of Sale/Sharing: We do not sell or share your personal information for cross-context behavioral advertising. If this changes, you will be notified.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any CCPA rights.
  • Shine the Light: California residents may also request information about disclosure of personal information to third parties for their direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.

9.3 Additional Rights — India Users (DPDP Act, 2023)

When applicable provisions of the Digital Personal Data Protection Act, 2023 are notified and in force, India Users will have the following rights as Data Principals:

  • Right to Information: The right to obtain information about how your personal data is processed.
  • Right to Correction and Erasure: The right to correct or erase your personal data.
  • Right to Grievance Redressal: The right to a readily available means of grievance redressal.
  • Right to Nominate: The right to nominate another individual to exercise data rights on your behalf in the event of death or incapacity.

Cookies and Tracking Technologies

We use cookies and similar tracking technologies on the Platform. Cookies are small data files placed on your device when you visit our website. We use the following categories of cookies:

  • Strictly Necessary Cookies: Essential for the Platform to function. Cannot be disabled without impairing Platform functionality. These do not require your consent.
  • Performance and Analytics Cookies: Collect information about how users interact with the Platform to help us improve its performance and usability (e.g., Firebase Analytics).
  • Functionality Cookies: Remember your preferences and settings to enhance your experience.
  • Marketing and Targeting Cookies: Used to deliver relevant communications. These are only set with your consent where required.

AI Processing and Automated Decision-Making

The Platform uses artificial intelligence and automated systems to process call recordings and communications data. This includes:

  • Automated transcription of call recordings using AI speech recognition models;
  • Automated sentiment analysis and intent scoring of call transcripts;
  • Automated lead scoring and Meaningful Interaction (MI) determination;
  • Automated coaching recommendations and performance analysis.

You acknowledge that: (a) AI systems may produce inaccurate or incomplete outputs; (b) CallQuants LLP makes no warranty as to the accuracy of AI-generated outputs; and (c) you remain solely responsible for decisions made based on AI-generated outputs. The MI determination for billing purposes is an automated decision made by our proprietary AI; if you believe a determination is erroneous, you may contest it by writing to help@callquants.us.

We do not use your personal data to make automated decisions that would have a significant legal or similarly significant effect on you without your knowledge, except to the extent that MI-based billing determinations are an automated function inherent to the Service you have subscribed to.

Children's Privacy

The Platform is not directed to, and we do not knowingly collect personal data from, individuals under the age of eighteen (18) years (or the applicable age of majority in your jurisdiction). If we become aware that we have inadvertently collected personal data from a child, we will take prompt steps to delete such data. If you believe we have collected personal data from a child, please contact us immediately at help@callquants.us.

Third-Party Links and Services

The Platform may contain links to, or integrations with, third-party websites, services, and platforms. This Privacy Policy does not apply to such third-party services. We have no control over and are not responsible for the privacy practices or content of third-party services. We encourage you to review the privacy policies of any third-party services you access.

Marketing Communications

We may send you marketing emails, product updates, and promotional communications relating to CallQuants LLP services. You may opt out of receiving such communications at any time by: (a) clicking the 'unsubscribe' link included in any marketing email; or (b) writing to help@callquants.us with the subject line 'Unsubscribe.' Please note that even after opting out of marketing communications, you will continue to receive transactional and service-related communications necessary for the operation of your Account.

Jurisdiction-Specific Privacy Provisions

15.1 US Users — Federal and State Privacy Laws

  • CCPA/CPRA (California): As described in Section 9.2. We do not sell or share personal information for cross-context behavioral advertising. To submit a verifiable consumer request, email help@callquants.us.
  • CAN-SPAM Act: We comply with the CAN-SPAM Act. All marketing emails contain a functional unsubscribe mechanism. We will honor opt-out requests within ten (10) business days.
  • TCPA: Where we send text (SMS) messages as part of the Services, we comply with TCPA requirements. If applicable, you may opt out of SMS communications by replying 'STOP' to any such message.
  • State Privacy Laws: We acknowledge the privacy rights of residents of states with comprehensive privacy legislation, including Virginia (VCDPA), Colorado (CPA), Connecticut, Texas, and others. To the extent applicable, we will honor rights substantially similar to those described in Section 9.
  • HIPAA Notice: The Platform is not a HIPAA-covered entity and is not designed or intended to store Protected Health Information (PHI). Do NOT use the Platform to process PHI.

15.2 India Users — Indian Data Protection Law

  • Information Technology Act, 2000 and IT (SPDI) Rules, 2011: We comply with the requirements for collection, storage, and processing of sensitive personal data or information as applicable under these rules.
  • DPDP Act, 2023: We are committed to compliance with the Digital Personal Data Protection Act, 2023 as and when applicable provisions are notified and come into force. We will update this Policy to reflect DPDP-specific requirements upon notification.
  • Consent Framework: We collect your personal data only with your free, specific, informed, unconditional, and unambiguous consent where required by Indian law. You may withdraw consent at any time, subject to the consequences of such withdrawal.
  • Data Localization: Certain categories of personal data relating to India Users may be stored in India in compliance with applicable data localization requirements.

Changes to This Privacy Policy

CallQuants LLP reserves the right to update, modify, or replace this Privacy Policy at any time. The date of the most recent revision is indicated by the 'Last Updated' date at the top of this document. We will notify you of material changes to this Policy by: (a) posting a prominent notice on the Platform; (b) sending an email to the address associated with your Account; or (c) such other method as required by applicable law. Your continued use of the Platform following notice of material changes constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically.
